Surber faces new charges
Accused murderer shot at City Hospital, medical condition unknown

MARTINSBURG - Accused murderer Donald Berkley Surber Jr. now faces a new criminal charge after his unsuccessful escape attempt at City Hospital Friday night, which ended with him being shot after he reached for a correction officer's gun, police said.
Martinsburg Police Detective Lt. G.B. Swartwood said Saturday in a news release that Berkeley County Magistrate Harry Snow has issued a felony warrant for escape from a correction facility for Surber.

TERRE HAUTE — Federal prison guards opened fire on an inmate while breaking up a fight at the U.S. Penitentiary in Terre Haute on Thursday. A second inmate also was hospitalized with unspecified injuries.
“Two inmates were transported to the local hospital for treatment of their injuries with one inmate sustaining a gunshot wound,” prison spokeswoman Hattie Sims said in a brief statement distributed to news outlets.
Sims said she had no further information on the condition of the injured inmates or the nature of their injuries.
“That is all we have right now,” Sims told The Associated Press. “We are secure here. The public is not at risk.”

Altercation at FCI leaves three with minor injuries

An altercation at the Big Spring Federal Correctional Institution Thursday night left three people injured, including two correctional officers.
The injuries were minor, prison officials said.
According to information released by Selma Garcia, executive assistant to the warden, the situation started with a fight among the inmates around 9:30 p.m.
“A fight between inmates occurred inside a housing unit,” Garcia said. “The staff immediately restrained all inmates that were involved without further incident.
“As a result, two staff members sustained minor injuries and were treated at a local hospital and released. One inmate sustained minor injuries that required outside medical attention and was returned to the institution. An investigation into the incident continues.” ... [Read More]

A manager at U.S. Penitentiary Atwater predicted that someone would be killed if the two inmates accused of murdering correctional officer Jose Rivera were allowed to live near each other, according to a newly released FBI report. Even so, the inmates were placed in the same housing unit, the report says.
Rivera, a 22-year-old Navy veteran, was stabbed to death by two inmates inside a housing unit at the prison on June 20, 2008.
One of the inmates accused of killing him, James Leon Guerrero, was transferred to USP Atwater for disciplinary reasons the day before the murder. According to the FBI report, which was released this week by an attorney representing Rivera's family, a housing unit manager at the prison warned against placing Guerrero in the same unit as Joseph Cabrera Sablan, the other inmate accused in Rivera's murder.
